In the name of God Amen, I Cuthbert COMBS of Clarke County &n State of Kentucky being well in health and of sound mind calling into mind the mortality of my body & knowing it is appointed for all men once to die do make this my last will & testament in the following manner & form.

As Ten of my Children viz. Betsey EDWARDS formerly Betty COMBS Joseph COMBS Benjamin COMBS Polly EVANS formerly Polly COMBS John COMBS Sythe PAYNE formerly Sythe COMBS Susan RICHMAN formerly Susan COMBS Cuthbert COMBS Sally EVANS formerly Sally COMBS and Nancy PAYNE formerly Nancy COMBS have married and received part of my estate. Therefore I desire they should not receive anymore until the death of my wife Sally COMBS. Then I give and bequeath to my son Ennis COMBS a Negro man as son to Sarah to him and his heirs forever a bed and furniture a horse saddle and bridle a cow and calf thirty barrels of corn and one thousand weight of pork to be received when he attains the age of one and twenty years or before if he marries. Then I gave and bequeath to my two sons Fielding Alexander COMBS and Ennis COMBS one thousand acres of land lying on Sympsons_re_(?) Creek in Nelson County and adjoining Wm. BRASEAR'S' Preem___ion(?) on the upper end and extending up the creek for quantity to have and to hold to them and there heirs in fee simple. Then I gave and bequeath to my loving wife Sally COMBS the use and occupation of all the land with its appurtenances contained within my settlement & preemption(?) on Howard's upper Creek in Clarke County except what I have deeded to Benjamin COMBS and Cuthbert COMBS William EDWARDS and Christopher DAWSON and after the death of my wife Sally COMBS I give and bequeath the last aforesaid tract of land which I loaned to my wife during her life to my two sons Fielding Alexander COMBS and Ennis COMBS to have and to hold to them and their heirs in fee simple. Therefore if either of the aforesaid individuals viz. Nancy PAYNE Sally EVANS Susannah RICHMOND or Cuthbert COMBS lose their negroes or any of them by the course of law desire that the same may be purchased and redelivered to their respective owners or that each of the aforesaid individuals may be compensated according to their loss of receiving negroes of equal value from amongst those I have loaned to my wife Sally COMBS Then I desire after the death of my wife Sally COMBS that all the aforesaid negroes I have loaned her and the increase of said negroes also the money that is coming to me after the death of my mother by a _____(?) of my brother Fielding COMBS which money I loaned to my wife Sally COMBS during her life may be equally distributed among the following legatees, viz. SE Note: John Combs (b. c1800) and his wife Mary B. CLARK of Ky. migrated to Cooper Co., MO in the year 1822 per a biography of his grandson Joseph Combs. One Stephen Combs of Ky. married Synthey WRIGHT the same year (1822) in Cooper Co., MO. Also in Cooper Co. was a Robert CLARK. Boling CLARK, father of Polly CLARK, was the son of a Robert CLARK whose daughter Susanna married Joseph, son of Benjamin B. and Elizabeth PAYNE Combs. In 1840, there was also a Joseph Combs in Cooper Co. but he was gone in 1850.

COMBS, in 1821, land which the latter inherited from their brother, Marquis. (Clark Deed Book 17, 450.) The land was part of that bequeathed to Marquis C. COMBS by Marquis CALMES, Sr. (1793 Frederick Co., VA), but was within the 1,000-acre preemption of Marquis CALMES, Jr. under the commissioners' division of the five partners lands, by which 137 acres was taken from the grants of Marquis CALMES, Sr. and Benjamin BERRY and added to that of Marquis CALMES, Jr. (See suit papers of Calmes vs. Goff, et. al., Box 311 and 390.)" WILLIAMS, who intermarried with Polly COMBS, a daughter of said JOSEPH COMBS and Benjamin COMBS and Margaret his wife, John M. COMBS and Harrison COMBS and Fanny his wife, all of County of Stafford and State of Virginia of the one part and James FRANKLIN of Clark County and State of Kentucky who intermarried with Fanny G. COMBS, a daughter of the said Joseph COMBS, of the other part, witness that the said Mary COMBS, George H. TOLSON and Scythe his wife in their own right and the said George H. TOLSON as attorney in fact for and purchaser of Nathaniel P. WILLIAMS, Benjamin COMBS & Margaret his wife, John M. COMBS, and Harrison COMBS & Fanny his wife for and in consideration of the sum of one hundred dollars to them in hand paid before the signing and sealing of this indenture, the receipt of which sum they hereby acknowledge, hath granted, bargained and sold and by these presents bargain, sell and convey to said James FRANKLIN his heirs and assigns forever all their right, title and interest of them the said Mary COMBS, George H. TOLSON & Scythe his wife and the said George H. TOLSON as attorney in fact for and said peruchaser of Nathaniel P. WILLIAMS, Benjamin COMBS & Margaret his wife, John M. COMBS and Harrison COMBS & Fanny his wife to a certain tract or parcel of land being the residence part of a tract of land for which the said Joseph COMBS attained patent and hereby conveyed premises are on the waters of Upper Howeard's Creek, Clark County and State of Kentucky. He the said James FRANKLIN to have and to hold the right, title and interest of the parties aforesaid in and to the said tract, parcel or piece of land to him and his heirs and assigns forever.
