Notes: By 1800, Cuthbert Combs, Sr. had moved to Clark Co, KY, where he appears on that county's tax list in 1800 (Cuthbert was not on 1795 Clark KY tax list, but in 1797, his son, Joseph m in Clark Co).

In the name of God Amen. I Joseph COMBS of the County of Stafford and the State of Virginia make this my last will in manner and form following, to wit: My will is that my wife hold and enjoy the tract of land on which I now reside so far east as my fence which is nearest my land in the occupation of my son in law John H. COMBS for the joint support of herself and my unmarried children, together with all my personal estate, for the same purposes till she shall marry or my youngest child shall arrive at the age of twenty one years, and when either take place, it is my will that my estate shall be so divided as that my wife shall only have the one third part thereof for and during her life.
My will is that so soon as it can be done out of the sale of land which I shall hereafter direct sold, or out of the profits of my estate, that the sum of five hundred dollars including about fifty four dollars already advanced her in property be given to my daughter, Polly WILLIAMS, and that a like sum of five hundred dollars be given each of my unmarried children whenever she, or he, shall marry or arrive to the age of twenty one years, as that sum being advanced as above stated will put those children on an equal footing with my daughter, Seth TOLSON, and my daughter, Sophia COMBS, who have each received about five hundred dollars.
It is my will that when my wife shall marry or my youngest child shall arrive at the age of twenty one years, the whole of the balance of my estate be equally divided amongst all my children who may then be alive except that part which may be allotted my wife as her third part; and it is also my will that at the death of my wife, my whole estate be equally divided amongst all my children or the survivors of them, having due regard to the advances already mentioned and which are to be deducted from the share of those whom I have mentioned as having received the same;
It is further my will that the whole of my land except that part set apart for the support of my wife and unmarried children, be sold on such credit as will carry the foregoing part of my will into effect so soon as it can conveniently be done after the death of my Mother (the Grave Yard excepted);
The Cain given me by Cuthbert BULLETT, esqr. I give to my Mother.
I appoint my nephew, Seth COMBS, and my friend, Enoch MASON, executors of this my last will. Given under my hand and seal this 6th day of January 1810. Joseph COMBS

Notes: Joseph Combs' reference to Cuthbert BULLITT and to his mother (Seth BULLITT) identifies him as the son of John COMBS, Sr., all three of whom are named in the 1766 Fauquier Co, VA will of her father, Benjamin BULLITT (See John Combs, Sr.). His will documents the marriages of his daughter, Polly, to a WILLIAMS, his daughter, Seth, to George TOLSON, and his daughter, Sophia, to a John H. Combs. Later Stafford County records document that Polly had m Nathaniel WILLIAMS, and that Seth had m George TOLSON. The Edna F. Hightower Collection (T. E. Anderson Letter) states that John Harrison Combs (s/o Benjamin & Sarah RICHARDSON Combs) was born in Stafford Co, VA, married "his own cousin," and removed to Fayette Co, KY (although not in that order), and later records confirm that John Harrison & Sophia did leave Stafford for Kentucky.* Joseph's nephew, Seth, was the s/o his brother, Ennis, of Fauquier Co, VA. See below re additional children.

*Note: The Combes Genealogy… states that John Harrison COMBS m Sophia BULLOCK, not COMBS, but no record of that marriage has ever been located and it seems possible that the source was oral family history, with her name having perhaps been Sophia Bullock or Sophia Bullitt Combs, and an early researcher mistaking her middle name for a surname. Documenting the relationship is the fact that the children of Joseph Harrison & Sophia COMBS of Clark Co, KY are also the heirs of Joseph & Mary PRITCHETT Combs (See 4 Jun 1850 Stafford Co, VA records).

Polly WILLIAMS [Combs] listed in document regarding the bequest of a female slave and children from Benjamin PRITCHETT of Prince William [Co VA] to his daughter Rebecca WEEDON [who was also the daughter of Sally WEEDON ??] --the slave was valued at $300 - to be held by Rebecca to her death and then to go to Polly WILLIAMS and/or her children -- her children listed as Joseph WILLIAMS, Pearson WILLIAMS, John WILLIAMS, Frances WILLIAMS, Maria WILLIAMS, James WILLIAMS and Margaret WILLIAMS.

dated May 31, 1820. Public Sale.

By virtue of a Deed of Trust, executed to the subscriber by George BAGGOTT, on the 30th day of December, 1818; will be sold on the 24th day of June next, to the highest bidder for ready money, at the House now occupied by Sanford CARTER, (on the premises,) the Tract of LAND, In the said deed mentioned; or so much thereof as may be sufficient to raise the sum of $746.25, which became due Enoch MASON, executor of Joseph Combs, deceased, on the 28th day of December, 1819; together with the interest that may be due, and the costs attending the sale. This tract of land contains 447 acres and 3 roads, is situated near the upper end of Stafford County, and is the same land which was conveyed by the said Enoch MASON, executor aforesaid, to the said George BAGGOTT, on the 30th day of December, 1818. This indenture made this third day of April in the year of our Lord eighteen hundered twenty two between Mary Combs, widow of Joseph Combs, deceased, GEORGE H. TOLSON and Scythe his wife and this George H. TOLSON as attorney in fact for and purchaser of the right, title and interest of Nathaniel P. WILLIAMS, who intermarried with Polly Combs, a daughter of said Joseph Combs and Benjamin Combs and Margaret his wife, John M. Combs and Harrison Combs and Fanny his wife, all of County of Stafford and State of Virginia of the one part and James FRANKLIN of Clark County and State of Kentucky who intermarried with Fanny G. Combs, a daughter of the said Joseph Combs, of the other part, witness that the said Mary Combs, George H. TOLSON and Scythe his wife in their own right and the said George H. TOLSON as attorney in fact for and purchaser of Nathaniel P. WILLIAMS, Benjamin Combs & Margaret his wife, John M. Combs, and Harrison Combs & Fanny his wife for and in consideration of the sum of one hundred dollars to them in hand paid before the signing and sealing of this indenture, the receipt of which sum they hereby acknowledge, hath granted, bargained and sold and by these presents bargain, sell and convey to said James FRANKLIN his heirs and assigns forever all their right, title and interest of them the said Mary Combs, George H. TOLSON & Scythe his wife and the said George H. TOLSON as attorney in fact for and said peruchaser of Nathaniel P. WILLIAMS, Benjamin Combs & Margaret his wife, John M. Combs and Harrison Combs & Fanny his wife to a certain tract or parcel of land being the residence part of a tract of land for which the said Joseph Combs attained patent and hereby conveyed premises are on the waters of Upper Howeard's Creek, Clark County and State of Kentucky. He the said James FRANKLIN to have and to hold the right, title and interest of the parties aforesaid in and to the said tract, parcel or piece of land to him and his heirs and assigns forever.
In testimony of which, the first parties to this indenture have hereinto subscribed their names and affixed their seal on the day and year above written.

(Excerpted by Combs-Million Researcher Dala Jo Cornett from the Family Bible of Cuthbert & Mary MILLION, parents of Elizabeth MILLION)

DJC Notes: Cuthbert MILLION, s/o Robert & Keziah HOLLIDAY Million, and brother of Sarah Ann MILLION who m 1775 William Combs, Sr. of Stafford. In a letter dated 7th June 1881 Adrian Arthur MILLION, son of Elijah and Elizabeth JAMESON Million (s/o Cuthbert & Mary), wrote to his brother John Mason MILLION and asked "write to me about old Aunty Betsy Combs where she is a living…" [This would indicate that Elizabeth MILLION Combs should be "findable" on an 1880 census]. The ancestry of RW William Combs has not yet been determined. It would seem probable that John M. Combs was the s/o Joseph & Mary PRITCHETT Combs (Research in progress). Cuthbert & Mary MILLION had removed to Madison Co, KY by 1830.

Va., for and in consideration of the sum of $55 to us in hand paid by John UPGRAFT, of said co. --- at and before the sealing and delivering of these presents the receipt whereof we do hereby acknowledged having bargained, sold, granted and affirmed, and by these present do hereby sell to the said John UPGRAVE a female slave SETTY and all her children, being the same female slave, given by Benjamin PRITCHETT to his daughter, Rebeeca WEEDEN, during her natural life , then to become the property of us during my (Polly WILLIAMS) natural life, to have and to hold, our interest in the said female slave named SETTY and all her increase to the only proper use and behove to the said John UPGRAVE, his executive , administrators, and assigns forever , and we Nathanial WILLIAMS and Polly WILLIAMS for ourselves , executors and administrators, the said interest in the said female slave, her children and future increase to the said John UPGRAVE , his executor administrator, assigns and against us the said Nathanial and Polly WILLIAMS our executors, administrators and assigns, against all every person, persons who by and under us shall and will warrant and defend. THIS INDENTURE made this 17th day of December in the year of our Lord eighteen hundred and twenty five Between BENJAMIN COMBS of the County of Stafford and State of Virginia of the one part and MARY COMBS, his Mother, of the same County and State of the other part. Winesseth that the said BENJAMIN COMBS for the sum of twelve hundred dollars hath granted unto the said MARY COMBS her heirs and assigns forever, all that parcel of land in the County of Stafford, which ENOCH J. BROWN and his Wife conveyed to BENJAMIN PRITCHARD by their Indenture of Bargain and Sale bearing date the first day of March in the year of our Lord 1805, which Deed is of record in the Clerk's Office of the County Court of Stafford, and to which Land he the said BENJAMIN COMBS derived title under the Will of the said BENJAMIN PRITCHARD and which after deducting therefrom a small tract of about six acres of land conveyed to NATHANIEL P.WILLIAMS, JUNIOR, on the sixteenth day of the present month will contain Four hundred and ninety nine acres, but is expressly understood between the parties that in making this conveyacne the said BENJAMIN COMBS excludes therefrom the small tract of land sold NATHANIEL P. Note: Kind of odd that the deed was made in 1825 but not recorded til 1849. Guess they "just didn't get around to it". Who is Ishmael Pritchett? Why did Ben Combs sell land to his mother? Had she not been provided for in Ben Pritchett's will? I am currently trying to research Benjamin Pritchett and what I have found on the web, suggests that the Pritchetts MAY have been related to the Rousseaus. That may explain Josiah Combs' identification of Mary as Mary Rousseau. (Bill Peters)

Note: This deed brings up the question again about who the Margaret Combs was who lived with Margaret "Peggy" Combs, widow of Ennis Combs, in the 1850 census. If she was Margaret Edrington, d/o Nancy Combs & William Edrington, and wife of the below mentioned Benjamin Combs (s/o Joseph & Mary Pritchett Combs), then what happened to their marriage? Did it end in divorce? Benjamin Combs married 2nd in 1851.
Without the evidence that you mention about Mary's death, (see Fauquier Co, VA 18 Aug 1853) I would suspect that this deed was filed in 1849 because Mary Combs did indeed die. She does not appear in the 1850 census, and the lawsuits brought by the heirs of Joseph Combs (h/o Mary) begin about that time. Mary Combs is in the 1840 census with an adult male living with her that could be Benjamin Combs. As long as Mary and Benjamin were alive, they may not have seen the need to file the deed.
Mention of Cuthbert Million connects Mary Pritchett Combs and son Benjamin to the John M. Combs who married Elizabeth Million in 1823 per the Cuthbert Million bible. We know that Joseph & Mary Combs had a son named John M. Combs, but there seem to be two of them. The other married Artemesia Brown Ralls in 1817 Stafford. Artemesia Combs lives near the children of Joseph & Mary Combs and Ennis & Margaret Combs, in 1850 Stafford VA census. Could Ennis have had a son named John M. Combs, not mentioned in his will? Witnesseth that for and in consideration of the sum of Four Hundred dollars in hand paid the receipt whereof is hereby acknowledged and three bonds each for Two hundred and Sixty six dollars and sixty six & two third cents payablr severally six, twelve, and eighteen months after date with interestthereon from date at six percent per anum, and a contract to saw out, stack, and give posession of Thirty three thousand three hundred and thirty three feet of Pine inch plank, to be one third of Long leaf and two thirds of Woods Pine, stacked with strips at the saw Mill yard, in monthly installments of one third each month from the time of commencing to saw the lumber the said E.A.W. HORE, K. E. COMBS, and undersigned heirs of DR. W. Wm. COMBS, an expert fisherman of local renown, caught with a hook and line, at the dam, last Saturday, a German carp weighing ten pounds 6 ounces. Fish are biting better than usual this spring and there are plenty of them.

Dead.
Mrs. S. J. COMBS died at her home in Stafford county Tuesday [Oct. 25, 1904], of consumption, aged 38 years. The deceased was Miss Lieu HAMMETT, daughter of Mr. John HAMMETT, of Stafford, and is survived by her husband and two children. The funeral took place Thursday at 11 a.m. and the interment was made in the family burying ground near Berea. Rev. Homer WELCH, of Morrisville, conducted the services.
