(Madison Co., KY Wills & Estates, 1785-1813, Abstracts, Charles M. Franklin, Indianapolis, 1986)

Notes: Was the above Nancy MILLION kin to John MILLION, son of Robert and Keziah HOLLIDAY Million of Stafford Co., VA, the latter parents of Sarah Ann MILLION, wife of RW William Combs, Sr.? (See below) The above Daniel DeJARNETT married Judith JOHNSON, daughter of James and (Susannah PAYNE?) Johnson of Lunenburg Co., VA.

Additional Notes: According to Jean McCracken (descendant of Travis MILLION) this Nancy Million is probably Nancy SIMS, daughter of Matthew SIMS and Martha EMBRY and the wife of Travis MILLION, son of Robert and Keziah MILLION. James DeJARNETT'S wife was Elizabeth SIMS, sister of Nancy Sims Million." Travis married Nancy on 17 Feb 1791 in Madison County, Kentucky. Her father, Matthew SIMS, son-in-law of Joseph EMBRY, moved to Madison County from Wake County, North Carolina. It isn't known if he moved at the same time Joseph EMBRY and his sons, Jesse, Joel and Tarlton did or if he went later. John MILLION [s/o of Robert} made application for a Rev. war pension in 1843 and stated in that application that he went to Kentucky in 1783. He was twenty. years old. I don't know if Robert and Travis went with him at that time. They were a few years younger. I do know they were there in 1790 and they both married in 1791.

18 June 1840 Heatherly, Miranda Jane, married Tiberius B. Ballard
1840 According to Josiah H. Combs' The Combes Genealogy, p. 124, in reference to RW William Combs (thought by some to have been a son of John "father of the 8 brothers" Combs, who died 1819 in then-Floyd Co., KY): "William ("Old Buckery"), lived in Perry, Breathitt, old Lincoln, Bath and Madison. Married Nell CLOUD, (61 years old in 1820), probably in old Shenandoah [Co VA], William 63 in Sept., 1820. Died in Madison Co., [KY?] 1840.

Notes: A review of Dorman's abstract of William Combs' RW Pension file states only: "The administrator of William Combs was paid pension to 8 Mar 1840, the date of his death," but does not state the county of death, nor to whom the final check was paid. Madison County court records show that William died on 8 March 1840 (see below) per oaths of Leland D. MAUPIN and James SHEARER. The administrator of his estate was his son-in-law James B. HEATHERLY and is likely the one who claimed his final pension check. Madison County probate records for William show that he was closely associated with the children and grandchildren of his daughter Wilmoth Combs BANTA.

1840-1842 The estate of William Combs:

4 Nov. 1840. Madison Co., Ky. Satisfactory proof was this day made in open Court by the oaths of Leland D. MAUPIN and James SHEARER that William Combs late a Pensioner of the United States departed this life on the 8th day of March 1840 and that the said William Combs was the identical person named in an Original Certificate now here shown to the Court bearing date the 29th of June 1819 and signed by J. C. CALHOUN Secretary of War granting to the said William Combs a pension of $8 per month and numbered 12382 - And it was further proven Satisfactorily to the Court that he left no widow but that James HEATHERLY is his Administrator. (Source: Original Madison Co., Ky., Court Order Book H (1839-1845): 90, submitted by Sue Elfving)

SE Note: James HEATHERLY was the son-in-law of William Combs having married his daughter Margaret Combs on 13 July 1820. The MAUPIN familly was associated with the BANTA family in that one James MAUPIN married Elizabeth BANTA, the daughter of Wilmouth Combs and Henry BANTA and therefore the granddaughter of William Combs. The above court record would also suggest that William died in Madison Co., Ky.

6 April 1840. Madison Co., Ky. On the motion of James B. HEATHERLY Letters of Administration is granted him on the estate of William Cobs Dec'd. Bond for $1500 with Henry BANTA and John E. M. McHENRY his security. Appraisal ordered. (Source: Original Madison Co., Ky. Court Order Book H (1839-1845): 38, abstracted by Sue Elfving)

SE Note: The name on the estate was indexed as William Combs. Henry BANTA, security, was another son-in-law. The relationship, if any, of John E. M. McHENRY, has not been determined.

Notes: This inventory indicates that William Combs was not indigent as he had so indicated in his RW pension affidavits. An indigent individual would not have been able to loan monies in the amount as indicated by the notes due listed in the inventory. The list of individuals to whom he loaned money suggest he was very close to the family of his daughter Wilmouth Combs BANTA since several of his granddaughters' husbands (Boulware, T Heatherly, and BF Goode) owed him money.

25 Nov. 1840 Will of Henry BANTA, probated 3 Feb. 1841, Madison Co., Ky.

Excerpts from the Wills of Henry BANTA (Original source: Madison Co., Ky. probate records as presented on Ralph J Turner's website)

Dated and signed 25 Nov. 1840, Henry styles himself as being of Madison Co., Ky. The will was produced in court on 3 Feb. 1841; therefore, Henry died between 25 Nov. 1840 and 3 Feb. 1841. Witnesses were William Oldham and John R. Moberly. He directs that "his new house shall be comfortably furnished as a residence for my wife Wilmouth Banta, and that the dower be laid off to include said building in a proper and farmer like manner." The remainder of the land and personal property (excepting wife's one-third) was to be divided equally between his children. He also directs that his son Peter and his children not to be charged for "board or anything else…whilst residing with me, and as I intend to keep them during my life. Peter's attention to my business & services being in my opinion a full equivalent for their board, etc." In a P.S , Henry gives to his wife in addition to her dower a bay horse colt given her by her father, and he directs that his daughters Wilmoth, Miranda, & Merva are to receive a silver spoon, the same as he has previously given to his other daughters.

SE Note: If Wilmoth had a colt from her father, the gift would have been recent since the horse is still referred to as a colt. Could this mean her father William is still alive or could she have received the colt from his estate? In either case, the gift was of a recent nature. According to Madison Co. court records, William Combs died 8 March 1840. Henry's will was dated 25 Nov. 1840. Had she just received the colt?

29 June 1841. Conveyance of Personal Property by Wilmouth BANTA. (Source: Ralph J Turner's website with his sources quoted as: Madison Co., KY Land Records. Deed book G, p 488,489. LDS Film 183287; Book H, p 130-132, LDS Film 183288; Estate papers in Madison Co., KY, See Land Records Vol 2 p 437.). Document was signed on 29 June 1841

This gift of personal property by Wilmoth to her daughters and granddaughters establishes a close relationship between her family and the HEATHERLY family. Wilmoth mentions her daughters Hetherlys and her granddaughters Elizabeth and Zarelda Hetherlys and she also states that some property she had given to her daughters had been sold (per court order) as the property of Thomas HETHERLY, likely the same as who, on 19 Oct., 1820 in Madison Co, married Margaret BANTA (daughter of Henry and Wilmoth). This Heatherly link seems to suggest that Margaret Combs, daughter of William "8" Combs, who married James B. HEATHERLY in Lincoln Co., would have been a sister to Wilmoth and therefore the daughter of the same William Combs. The name of the second daughter who married a HEATHERLY is not clear. Banta researchers refer to this recorded gift as a will; however, there is evidence she remarried on 20 Oct. 1842; therefore, the original record is needed. A review of the original record shows the property that Wilmoth gifted was purchased by her from the court ordered sale of property belonging to Thomas HEATHERLY and in NO way indicates it should be viewed as any kind of will. She apparently was buying items she felt should remain with her HEATHERLY children/grandchildren.

More information on the family of Henry BANTA and Wilmouth Combs can be found in their family report.

SE Note: It is possibly that Wilmouth remarried to Enoch M. SMITH (see above 20 Oct. 1842 marriage record). What has been presented as a will by Banta researchers may just be a gift of personal property that became involved in a court case. The 1842 marriage record states Mrs. Wilmouth BANTA.

20 Oct. 1842. Madison Co., Ky., Marriage Bond for Mrs. Wilmouth BANTA and Enoch M. SMITH.

20 Oct. 1842. "Know all men by these presents that we Enoch M. Smith and Alonzo (Lumb or Lamb) are held and firmly bound unto the Commonwealth of Kentucky in the just & full sum of fifty pounds current money to which payment will and truly to be made we bond ourselves, our heirs &c jointly & severally by these presents sealed and dated this 20 day of October 1842. The condition of the aabove obligation is such, that whereas there is a marriage shortly intended to be had & Solemnized between the above bound Enoch M. SMITH of Boyle County, Ky. and Mrs. Wilmoth BANTA of Madison County Ky. Now if there be no lawful cause to obstruct the same, then the above obligation to be void, else to remain in full force _____. E M Smith (Seal), Alonzo lamb (Seal). Test. Tho H. Barnes DC Memo: Both of the within parties of full age. Att. David Irvine Clk by Thom H Barnes DC (Source: Transcription of original marriage bond, Madison Co., Ky. Courthouse, submitted by Sue Elfving)

Note: The marriage bond clearly shows the bride was styled Mrs. and being of the age of consent therein giving credence to the probability that she was the same as Wilmoth Combs, widow of Henry BANTA decd. Also interesting to see that Enoch M. SMITH was styled as being of Boyle Co. In 1850 in Lincoln Co., Ky., there is an Enoch M. SMITH, age 77, living in the household of John and Susan Warren. If he is the same Enoch, then Wilmouth may have died by 1850.

27 Jan 1893 Elizabethtown News, (Hardin Co., Ky). Charles Combs of Madison Co. [KY], with several boys, tied a Roman candle to a dog's tail, lighted it and prepared for sport. The candle did not discharge for some minutes, and Combs, thinking that the fuse was not ignited, attempted to relight it, when it exploded. Some of the balls of fire entered his mouth. One of them went down his throat, lodged in his stomach. Three physicians are in regular attendance on the unfortunate man, but his recovery is exceedingly doubtful.
