Jackson Combs GW Combs Fielden Combs, Andrew Combs, [blank] Combs Riley Combs Dicy Combs Subriny Caudill Watson Caudill Mary Combs Remines [sic] Combs, Perlina Combs Nancy Ann Combs & Sally Combs Against Shadrick Stacy} Petition in Equity

Pltffs say that all the pltffs except Sally Combs are the children & heirs of Jery L Combs Jr decd.  That Sally Combs is his widow that Sabrina married Watson Caudill & Mary married Reminis Combs.  They say that in the year 1854, deft. sued their ancestor in this Court for a tract of land lying & being in the County of Perry on Cars Fork & of the North fork of the Ky. river, that the farm of said Stacy & the land of their father joined & that the principle dispute between them was the Conditional or division line between their farms.  That the contentions mainly kept up for some years when a fire broke out & caught into the fence which was the conditional line & it burned up & said Combs by that _______ having come to the conclusion that his conflicting claim was not worth the expense of sustaining it declined to rebuild it, & thus the _________ ________ along for some time, when deft Stacy rebuilt said fence.
      But sometime in the year 186_ pltffs father was killed & several of the pltffs were infnts & the contest thus diminished induced the deft to prolong the continuation of said action until the lapse of time had _______the _______ of said cause as against the pltfs & becomming piqued by the heavy __________ of the accumulated Cost, on the 16th day of October 1867, he filed his petition & commenced an action against these pltfsfor the same land, & on the 3 day of June 1874, the pltffs the most of whom, those who are defts in that action filed their answer & said petition by which they rennenced [sic?] all claim to said land or any part of it - denied that they were in possession of land or any part of it, that he take some depositions at the J___ term of the court 1867.

10 June 1852 (PC-DBD:536-7). Conveyance of Slaves. I, Jackson G. Combs of Perry County for $200 paid by Isaac B. Combs of Breathitt County....sells 2 heirs parts in two certain Negro slaves, belonging to George Combs's heirs and now in the house of Liddy Combs, which parts have been bought from Samuel Combs and wife and of Samuel HUNLEY and wife, heirs of the estate of G. Combs. 10 June 1852. Signed Jackson G. Combs H. G. Crooks [No acknowledgment entries or names of wives given] (Transcribed by Sue Elfving; please see note above on Deed Book D)

SE Notes: This deed identifies the wives of Samuel Combs and Samuel Hun(d)ley as heirs of George "8" Combs, and further confirms an earlier deed that shows George had a daughter named Eliza [who married secondly Samuel Combs, see 1850 Perry Co. census] and a daughter named Elizabeth [who married Samuel Hundley]. The Liddy Combs of the record may refer to Lette Combs, wife of Moses Combs and daughter of George, or it could refer to George's widow Liddy HACKER. Isaac B. Combs was the son of Mathew and Frankie BROWN Combs Jr. and the grandson of Henry "8" Combs.

No Andrew Combs is found in Perry Co., KY Census of this age to have been a son of Jackson D. either.

Nancy married Robert DAVIDSON and they resided in Breathitt Co. Dorcas married Wayne DAVIDSON. John WALKER had married Polly Combs by 1837 (10 Aug 1853 Perry Co., KY Records and 1850 Perry Census). R. C. Combs was Robert C. who married Eliza Combs (1851-1859 Perry Co., KY Records). According to Josiah H. Combs' Combes Genealogy, Gen. Notes: (1) Margaret "Peggy" Combs was the daughter of Jeremiah L. "Long" Combs, Sr. and widow of Nicholas S. Combs, Jr. (son of Nicholas Combs, Jr. and Elizabeth Combs) who appears to have been the above Nicholas deceased (as versus either Nicholas S.'s father, "Squire" Nicholas "Birdeye" Combs, Jr., or his paternal grandfather, Nicholas "8" Combs, Sr.) given that both of the latter two were still alive at this time (RW Pension file of NicholasSr.). (2) There was also, however, a Nicholas Combs who died 31 Aug 1853, Owsley Co., KY, son of N and Mary Combs Combs, about whom no more is known. (3) The above Jesse was probably Jesse Combs, Sr., son of Elijah "8" Combs. R. C. Combs was Robert C. Combs, son of Samuel and Nancy CORNETT Combs(?), and husband of Eliza Combs, daughter of Jeremiah C. "Chunky" Combs & Syntha SUMNER Combs (daughter of Samuel and Winnifred Combs Sumner (Hicks). (4) Moses may have been son of Jeremiah C. "Chunky" Combs.

With Elizabeth, are 3 young children including an Elijah, as well as Sarah PATTON, age 51.

GODSEY and wife Sytha, Andrew Combs, John WALKER Jr. and wife Polly, Robert DAVIDSON and wife Nancy. Recorded 4 Sept. 1854.

SE Note: The above heirs were those children by Jeremiah's first wife Syntha aka Sytha SUMNER. Wayne DAVIDSON, the widower of deceased daughter Dorcas, had removed to Page Co., IA by 1850 with his father Samuel DAVIDSON, son of RW Soldier Daniel DAVIDSON. Daughter Nancy had married Robert DAVIDSON, youngest son of RW Daniel DAVIDSON and also an uncle to Wayne DAVIDSON. Robert and Nancy resided in Breathitt Co.

Notes: Jeremiah C. "Chunky Jerry" Combs. See also 19 Jan 1853-7 Feb 1853 (Perry Co., KY DBC:261). There were two conveyances from the heirs of Jeremiah C. Combs decd. dated 7 April 1854. The one above was to Moses Combs. JP Downard's abstraction for the Perry Co. USGenweb site does not include the name of Robert DAVIDSON in the list of those who signed as heirs and grantors; HOWEVER, an abstraction of the same conveyance by other researchers does include Robert DAVIDSON's name as does the second conveyance (see next). Robert H.GODSEY married Sytha Combs before 1850 (above records and 8 Nov 1852 Perry Co., KY Records). They are found on the 1850 Scott Co., VA and 1870 Perry Co., KY Census enumerations (The Combes Genealogy erroneously lists Robert H. as Oscar GODSEY). Nancy married Robert DAVIDSON. Dorcas married Wayne DAVIDSON. John WALKER had married Polly Combs by 1837 (10 Aug 1853 Perry Co., KY Records). R.C. Combs was Robert C. who married Jeremiah C.'s daughter, Eliza Combs (1851-1859 Perry Co., KY Records). According to Josiah H. Combs' Combes Genealogy, Gen. Table, p. 135, an "Eliza (Ella) Combs" (ancestry not shown) married Robert C. Combs, son of Samuel and Nancy CORNETT Combs. . (no source), but on p. 140 of General Table, erroneously lists Elizabeth (rather than Polly Ann) as having married John WALKER.

"I Elijah Sr. of Perry County and State of Kentucky being weak in body but of sound mind and disposing memory do hereby make my last will and testament in manner and form following: That is to say that I give to my son Jesse Combs, my negro man, Lewis. Also the land in the following boundary lying and being in Perry County." (There follows a minute description of a large boundary of land.) "I desire that my son Jesse Combs shall have the use of the above mentioned land and negro man Lewis during his natural life. But they shall not be sold to pay his debts and shall be used only for the use of his family and at his, my son Jesse's death, I give the above mentioned negro and all the above mentioned land to my three grandsons to wit: Josiah H. Combs, Jesse Combs, and John Combs to be equally divided amongst them.

I also give to my son Jesse Combs two cows, one horse and ten head of common sized hogs, also two feather beds. I give to my son Jackson G. Combs, two negro women, Nancy and Mary. Also, all the balance of my property on my farm. Also, all the balance of my house furniture, beds, etc., also all the land I hold in the following boundary." "I heretofore have given to the balance of my children their part of my estate all that I intended to give them, and lastly I do hereby constitute my grandson Josiah H. Combs executor of this, my last will and testament hereby revoking all other or former wills and testaments by me heretofore made. Nancy relinquished her right of dower. Acknowledged by grantors and admitted to record 16 Jan. 1856 but not recorded or rerecorded on 27 Feb. 1874.

For $300...(1) 20 acres in Perry County on Carrs Fork; (2) 100 acres more or less in Perry County on Carrs Fork on the south side of the creek, and (3) 50 acres more or less...another survey on south side of said Fork...at the lower end of Byrum Combs's farm...signed Nicholas x SMITH, Nancy x SMITH. Jackson and Mary Ann's son, Anderson, died 1943, Knott Co., KY naming his parents Jack Combs and Mary YOUNG.

Notes: Hugh Combs was listed in 1850 Perry Co., KY Census in HH of his parents, Henry and Nancy Ann BROWN Combs, Jr. The age of his daughter would indicate that his marriage to Nancy FRANCIS took place very shortly after census enumeration.
